Belgian DPA Signs Joint Statement on Privacy Risks of AI-Generated Imagery
On 23 February 2026, the Belgian Data Protection Authority (DPA) joined 60 other global data protection authorities in signing a Joint Statement on AI-Generated Imagery. The statement addresses serious privacy concerns related to AI systems that create realistic images and videos of identifiable individuals without consent, with particular emphasis on protecting children.

EDPB Orders Belgian DPA to Investigate NOYB Cookie Complaint Against VRT
The EDPB has issued a binding decision instructing the Belgian Data Protection Authority (DPA) to assess the merits of a complaint lodged by NGO NOYB concerning cookie banners on the Flemish public broadcaster VRT's website, rather than dismissing it. The Belgian DPA had initially proposed dismissal based on an alleged abuse of right, citing case law from the Brussels Market Court. The EDPB found insufficient evidence of abuse under the GDPR and requires the Belgian DPA to proceed with a substantive review.

FATCA: Market Court Refers 13 Preliminary Questions to CJEU
The Belgian Market Court has referred 13 preliminary questions to the CJEU regarding the FATCA intergovernmental agreement and its compatibility with EU data protection law. The questions address compliance with Directive 95/46/EC, the GDPR's Article 96, and the framework for international data transfers. This follows earlier decisions by the Belgian DPA prohibiting data transfers of 'accidental Americans' to U.S. tax authorities.
